SC restores Hadiya's marriage

The order comes on the plea filed by Jahan, Hadiya's husband, challenging a Kerala High Court order annulling his marriage with her.

A three-judge bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and Chandrachud pronounced the judgment today. SC orders Kerala Police to share with NIA the probe details of the case described by the HC as an instance of "love jihad".

The NIA was previously asked by the apex court to investigate allegations that the a terror angle was involved in Hadiya's conversion to Islam and subsequent marriage to Shefin Jahan. The Apex Court also said that the college authorities had to make all necessary arrangements for her hostel facilities to complete her studies there.

Ashokan later filed a Habeas Corpus petition in the Kerala High Court.

The Supreme Court has cancelled a Kerala High Court order annulling the marriage of Hadiya.

Hadiya Jahan, who is in her 20s, was born into a Hindu family, but converted to Islam and married a Muslim man. A top court bench allowed Ms Jahan to leave her father's custody and resume her studies in November.

Despite Hadiya's pleas, the court in November past year, placed her in the custody of her college administration until she completes her education. At that time, the apex court had not yet made a statement about the status of her marriage.

Hadiya had made a personal appearance in the apex court in November previous year, when she reiterated that she had converted to Islam out of her own choice and she wished to be united with her husband. The probe into the cases of Love Jihad by a well oiled network in Kerala would however continue, the Bench said. "I want to be with my husband", the 25-year-old woman, wearing a headscarf, shouted to media persons as she was being taken inside the Nedumbassery airport in Kochi amid tight security.
